LIABILITY RELEASE, WAIVER OF CLAIMS, ASSUMPTION OF RISK & INDEMNITY AGREEMENT
READ CAREFULLY – THIS IS A LEGAL DOCUMENT
1. ASSUMPTION OF RISK: I understand that Brazilian Jiu-Jitsu is a full-contact martial art and fitness activity involving inherent risks, including but not limited to serious bodily injury, permanent disability, paralysis, death, and property damage. These risks include throws, joint locks, chokes, takedowns, falls, physical contact, and use of equipment. I knowingly, voluntarily, and freely ASSUME ALL RISKS, whether known or unknown, foreseeable or unforeseeable.
2. HEALTH REPRESENTATION: I represent that I am in good physical and mental health and have no condition that would prevent safe participation or pose risk to others. I accept full responsibility for my medical condition and have consulted a physician if necessary.
3. COMMUNICABLE DISEASES: I acknowledge the risk of exposure to communicable diseases, including but not limited to colds, flu, bacteria, viruses, and COVID-19, and voluntarily assume all such risks.
4. RELEASE OF LIABILITY (INCLUDING NEGLIGENCE): I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Artistic Jiu Jitsu School LLC, its owners, officers, instructors, employees, agents, and representatives from any and all claims, INCLUDING CLAIMS ARISING FROM NEGLIGENCE to the fullest extent permitted by Illinois law.
5. INDEMNIFICATION: I agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS Artistic Jiu Jitsu School LLC from any claims, damages, losses, or expenses, including attorney’s fees, arising from my participation or breach of this agreement.
6. INSURANCE: I acknowledge that Artistic Jiu Jitsu School LLC does not provide medical insurance and that I am responsible for maintaining adequate coverage.
7. PERSONAL PROPERTY: I assume full responsibility for any loss, theft, or damage to my personal property brought into the Academy.
8. PHOTO & VIDEO RELEASE: I grant permission for Artistic Jiu Jitsu School LLC to photograph or record me and use my likeness for promotional, marketing, or educational purposes without compensation.
9. EMERGENCY MEDICAL AUTHORIZATION: I authorize Artistic Jiu Jitsu School LLC to obtain emergency medical treatment if necessary and accept financial responsibility.
10. MINORS: If the participant is under 18, the parent or legal guardian consents to participation and agrees to all terms on behalf of the minor and releases Artistic Jiu Jitsu School LLC from related claims.
11. OFF-SITE ACTIVITIES: This agreement applies to all on-site and off-site activities, including tournaments, seminars, and events.
12. RULES & CONDUCT: I agree to comply with all Academy rules and understand that participation may be suspended or revoked for violations.
13. DAMAGE TO PROPERTY: I agree to be financially responsible for any damage I cause to the Academy or its property.
14. DURATION: This waiver is ongoing and applies to all present and future participation unless revoked in writing.
15. GOVERNING LAW: This agreement shall be governed by the laws of the State of Illinois.
16. SEVERABILITY: If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force.
17. ENTIRE AGREEMENT: This document constitutes the entire agreement and supersedes all prior agreements or understandings.
18. CONTINUING EFFECT: This waiver shall remain in effect even after termination of participation.
19. ACKNOWLEDGMENT
I acknowledge that I have read and fully understand this agreement and sign it freely and voluntarily.
